Terry Franklin Speaks at 52nd Annual Heckerling Institute on Estate Planning

Partner Terry Franklin presented “The 1846 Last Will of John Sutton – What’s Not So New in Will Drafting and Contests” at the 52nd Annual Heckerling Institute on Estate Planning. His talk examined will drafting, the role of the attorney as counselor and witness, and the presentation of facts in a will contest trial. Mr. Franklin addressed this topic on the eve of the anniversary of the signing of the last will and testament of his ancestor, a Florida slave owner whose will emancipate the mother of his children and their offspring.

Mr. Franklin also participated on the panel “Trust Asset Protection Through a Tri-Focal Lens” examining the asset protection afforded beneficiaries through trusts from perspectives of the drafting attorney, trustees and other fiduciaries administering the trust, and those creditors seeking to reach the trust assets; and the panel “Ethics and Negotiations” discussing ethical and strategic implications in negotiating with counsel, clients, and advisors.

The conference took place January 22-26, 2018 in Orlando, Florida.
