Sacks Glazier Franklin & Lodise partner, Meg Lodise, participated on the panel, “Dealing With Overlapping Roles of Individual Fiduciary, Business Manager and Beneficiary,” at the America College of Trust & Estate Counsel (ACTEC) meeting on March 10-11, 2011. The program discussed the numerous issues that arise when one or more individual family members is appointed as a fiduciary, and is also the manager or officer of the closely-held family business. The panel examined the potential conflicts and the remedies available for both the “power holder” and the “non-power holder,” and discuss methods of dealing with these situations as well as proposing drafting solutions when such a situation is anticipated.
