Sacks moderated a panel “Last Beneficiary Standing: Identifying the Proper Parties in Breach of Fiduciary Duty Cases” at the American Bar Association Section of Real Property, Trust and Estate Law 20th Annual Symposia held in Washington, D.C. Panelists explored the standing requirements and related issues in breach of fiduciary duty cases, including: the rights and obligations of successor fiduciaries, as well as potential liability for not pursuing claims; related limitations periods for asserting claims; enforceability of exculpatory clauses; and attorney-client privilege issues that arise in these cases.
